Elia Margarita Moreno Gonz\u00e1lez hubiese solicitado por escrito su renuncia a la militancia activa del PRI ante el Comit\u00e9 Directivo Municipal de dicho partido en Colima, en fecha 13 de abril de 2023,<\/span><span class=\"Apple-converted-space\"><span class=\"s5\" style=\"line-height: 21.6px; font-style: italic\">&nbsp;<\/span><\/span><strong><u><span class=\"s6\" style=\"line-height: 21.6px; font-weight: bold; font-style: italic; text-decoration: underline\">para cumplir con el requisito de desvinculaci\u00f3n con el partido postulante de su candidatura en el proceso electoral anterior<\/span><\/u><\/strong><span class=\"s5\" style=\"line-height: 21.6px; font-style: italic\">, siendo que esta se present\u00f3 antes de la mitad de la duraci\u00f3n del cargo de Presidenta Municipal al que fue electa?<\/span><\/em><\/p>\n<p class=\"s4\" style=\"margin-top: 0px; margin-bottom: 0px; line-height: 1.32; caret-color: rgb(0, 0, 0); color: rgb(0, 0, 0); font-family: -webkit-standard; font-size: 18px; font-style: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: auto; word-spacing: 0px; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.3); -webkit-text-size-adjust: none; -webkit-text-stroke-width: 0px; text-decoration: none\"><span style=\"line-height: 21.6px\">&nbsp;<\/span><\/p>\n<p class=\"s4\" style=\"margin-top: 0px; margin-bottom: 0px; line-height: 1.32; caret-color: rgb(0, 0, 0); color: rgb(0, 0, 0); font-family: -webkit-standard; font-size: 18px; font-style: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: auto; word-spacing: 0px; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.3); -webkit-text-size-adjust: none; -webkit-text-stroke-width: 0px; text-decoration: none\"><span style=\"line-height: 21.6px\">Al respecto, el<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">Consejo General<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">contest\u00f3<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">por mayor\u00eda<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">que,<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">\u201c<\/span><span style=\"line-height: 21.6px\">sin prejuzgar sobre el caso particular, de existir la renuncia que se describe en la consulta que nos ata\u00f1e, es dable afirmar que la C. Elia Margarita Moreno Gonz\u00e1lez ha perdido la militancia al partido pol\u00edtico que la postul\u00f3 en el cargo de Presidenta Municipal de Colima, con independencia de que dicho instituto pol\u00edtico haya dado tr\u00e1mite a la misma e, inclusive, sin necesidad de que sea aceptada material o formalmente por \u00e9ste, debido a que la renuncia entra\u00f1a la manifestaci\u00f3n libre, unilateral y espont\u00e1nea de la voluntad o deseo de apartarse de la calidad de militante a un determinado ente pol\u00edtico<\/span><span style=\"line-height: 21.6px\">\u201d<\/span><span style=\"line-height: 21.6px\">.<\/span><\/p>\n<p class=\"s4\" style=\"margin-top: 0px; margin-bottom: 0px; line-height: 1.32; caret-color: rgb(0, 0, 0); color: rgb(0, 0, 0); font-family: style=\"line-height: 21.6px\">Adicionalmente, se aprob\u00f3 por m<\/span><span style=\"line-height: 21.6px\">ayor\u00eda<\/span><span style=\"line-height: 21.6px\">,<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">una modificaci\u00f3n en el sentido de<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">que,<\/span><span style=\"line-height: 21.6px\"><span class=\"Apple-converted-space\">&nbsp;<\/span><\/span><span style=\"line-height: 21.6px\">\u201c<\/span><span style=\"line-height: 21.6px\">no obstante, en cuanto a si es o no suficiente su renuncia para cumplir con el requisito de desvincularse con el partido postulante de su candidatura en el proceso anterior, se debe considerar que no resulta suficiente la sola renuncia, pues al respecto, deben cumplirse elementos adicionales que establece el criterio XXV\/2016, emitido por la Sala Superior del Tribunal Electoral del Poder Judicial de la Federaci\u00f3n, para que su renuncia surta efectos plenos<\/span><span style=\"line-height: 21.6px\">\u201d.<\/span><\/p>\n<p class=\"s4\" style=\"margin-top: 0px; margin-bottom: 0px; line-height: 1.32; caret-color: rgb(0, 0, 0); color: rgb(0,
